Welcome to Axivon. These Terms of Service (“Terms”) govern your use of axivon.co.za (the “Website”) and any purchases you make from us. By using the Website or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Website.

1. About Us

The Website is operated by Axivon (“Axivon”, “we”, “us”, “our”).

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order on the Website. By placing an order, you confirm that the information you provide is accurate and complete.

3. Products and Descriptions

We make every effort to display our products, colours, and descriptions accurately. However, we can’t guarantee that your screen displays colours exactly, or that every description is completely error-free. Product images are for illustration purposes and the actual product may vary slightly.

4. Pricing and Payment

All prices are shown in South African Rand (ZAR) and [include VAT / are VAT-exempt]. Shipping costs are calculated separately at checkout.

We reserve the right to change prices at any time without notice. The price you pay is the price shown at the time your order is placed. If a product is listed at an incorrect price due to an error, we may cancel the order and refund you in full.

Payment must be made in full at checkout using the payment methods available on the Website. Orders are processed only once payment has been confirmed.

5. Orders and Acceptance

Placing an order is an offer to buy. An order is accepted when we confirm it by email. We reserve the right to refuse or cancel any order, including where a product is out of stock, there is a pricing error, or we suspect fraudulent activity. If we cancel an order after payment, you’ll receive a full refund.

6. Shipping and Delivery

Orders are delivered within 3–12 working days after shipping. Full details are set out in our Shipping Policy, which forms part of these Terms.

7. Returns, Refunds and Guarantee

All products come with a 30-day guarantee. Full details on returns and refunds are set out in our Refund Policy, which forms part of these Terms.

You may also have a right to cancel your order within 7 days of receiving your goods under the Electronic Communications and Transactions Act, and rights relating to defective goods under the Consumer Protection Act. Nothing in these Terms limits those rights.

8. Use of the Website

You agree not to:

  • Use the Website for any unlawful or fraudulent purpose.
  • Attempt to gain unauthorised access to the Website, its servers, or related systems.
  • Interfere with the Website’s operation or introduce viruses or harmful code.
  • Copy, reproduce, or exploit any part of the Website without our written permission.

We may suspend or restrict access to the Website if we believe these Terms have been breached.

9. Intellectual Property

All content on the Website, including text, images, logos, graphics, and design, is owned by or licensed to Axivon and is protected by intellectual property laws. You may not use, copy, or distribute any content without our prior written consent.

11. Limitation of Liability

To the extent permitted by law, Axivon is not liable for any indirect, incidental, or consequential loss or damage arising from your use of the Website or our products. Our total liability for any claim related to an order is limited to the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded under South African law, including under the Consumer Protection Act.

The Website may contain links to third-party websites. We have no control over these sites and are not responsible for their content or practices.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Website after changes are posted means you accept the updated Terms.

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
